Acceptable Use Policy

1. INTRODUCTION

1.1. This Acceptable Use Policy is applicable to your use of the wedidit.wedding Platform to display wedding venues and services, and the wedidit.wedding Admin System to upload wedding venues and service listings for display on the wedidit.wedding Platform (“the Service”).

1.2. This Acceptable Use Policy forms part of your agreement with us for the Service.

1.3. We may change this Acceptable Use Policy as set out in the Terms and Conditions for the Service.

1.4. We reserve our rights to maintain the quality of listing and content on wedidit.wedding by making such directions in relation to modification of content that we consider reasonable in the circumstances. The rules in this Acceptable Use Policy are a list of our requirements. We may direct you to modify content that are reasonable in the circumstances.

1.5. We may interpret and apply the rules below in such reasonable manner that are appropriate in the circumstances having regard to maintaining the quality of our Platform.

2. YOUR OBLIGATIONS

2.1. You must abide by the provisions of this Acceptable Use Policy.

2.2. You must only use the Service for the purposes for which it was designed and offered and not for any other purpose including, but not limited to, any purpose stated in this Acceptable Use Policy as being not acceptable.

2.3. You must use the Service in a responsible manner, taking into account the effects your use of the Service may have on other users of the Service and the wedidit.wedding Platform.

3. ACCEPTABLE USE

3.1. It is acceptable to use the Service for the bona fide listing of venues and services for hire, on behalf of the person entitled to offer such venue or service and in accordance with the terms of this Acceptable Use Policy

3.2. Customers must only advertise within the category for which their venue or service best applies to, although multiple venues or services may be advertised under individual listings and in the appropriate category. For example a florist or photographer must not advertise in anything other than their respective category or a venue who offers a photopgraphy service or cake inclusive service must not advertise in the photography or cake category unless they offer these services separately from the use their venue and in such instances they do, the listing in such category cannot have any information pertaining to the venue.

3.3. Customers with subscriptions are permitted to advertise individual venues or services as per their paid subscription (or coupon code usage) in the applicable section of wedidit.wedding. Those customers must comply with both this Acceptable Use Policy and all Terms and conditions of the wedidit.wedding

4. WHAT IS NOT ACCEPTABLE USE?

4.1. It is not acceptable use of the Service to engage in any of the following practices, or to allow anyone else to engage in the following practices, in using the Service:

4.1.1. Listings other than venues or services used in the ceremony, reception or throughout the wedding day: Listing anything other than real venues or services.

4.1.2. Advertising your business: Using the Service to advertise your business in a listing other than the listing that you are paying for. Listing multiple venues, rooms or services under one listing.

4.1.3. Incorrect categorisation of venue or service:

(a) Listing properties categories other than in accordance with the categories set out in 3.2 above

(b) Listing properties for sale in the ‘Rent’ section and listing properties for rent in the ‘Buy’ section. We may in our discretion allow certain ‘Rent to Buy’ type listings to appear in both the ‘Buy’ and ‘Rent’ sections.

4.1.4. Misuse of fields: Placing irrelevant information in an information, description or picture field of a listing. You must only use the information, description or picture fields for inserting information that is intended for those fields. For example, inserting the name or contact details of your business or agency in the description header or property description field is not acceptable.

4.1.5. Watermarks in photos: Inserting a business name in a listing is not acceptable unless it takes the form of a transparent watermark with no colour inserted in the bottom right hand corner of the image with dimensions no greater than 170 pixels by 34 pixels.

4.1.6. Incorrect photos or pictures:

(a) Displaying a photograph, drawing or other image that is not a photograph, drawing or image of the venue or service being offered through the listing. Displaying photos of venues or services other than those provided specifically by the listing business is not acceptable.

(b) You must not use the image Functionality for any unlawful, illegal, malicious or improper purpose. For example it is not acceptable to display images that:

(i) may defame or discredit another person or business;

(ii) may disclose private, personal or confidential information;

(iii) might be considered obscene, offensive, menacing or abusive;

(iv) might infringe the intellectual property rights of others; or

(v) may violate any law, regulation, standard, content requirements or code promulgated by any relevant authority or industry body.

4.1.7. Borders around photos or pictures: Displaying a photograph, drawing or other image within a border that we consider detracts from the quality of the image on a listing.

4.1.8. Text or marketing in photos or pictures: Displaying text within a photograph, drawing or other image that we consider detracts from the quality of the image on a listing, or displaying any business marketing material through the use of branded objects in photos, such as signboards, cars and coffee cups.

4.1.9. Photo or image collages: Displaying a collage or combination of photos or other images within one frame on a listing.

4.1.10. Displaying ‘Lifestyle’ images as main image: Displaying a ‘lifestyle’ photograph, drawing or other image as the main image in a listing. We will have discretion to determine what constitutes a ‘lifestyle’ image for this purpose, but for guidance a lifestyle image will commonly be an image of some local environmental or structural feature or amenity, and not an image of the venue or service itself.

4.1.11. False street and place names: Using Street names, suburbs or location names that are inaccurate or not officially recognised. For example: stating that a property is within a neighbouring suburb is not acceptable.

4.1.12. Duplicate listing of properties:

Creating more than one listing for the same venue (room) or service. For example, listing a single room more than once, including but not limited to, listings with different prices, address details, styles selected or listings loaded into multiple Platform sections (e.g. listing a venue in the venue category and the car hire category is not acceptable unless there is a separate business service offered which can be hired / purchased without the other venue or service). However, a venue may legitimately be listed in the venue category and the cake section if it genuinely falls within both categories and offers both options seperately. A genuine listing of multiple rooms at the same address is not considered a duplicate listing of venues.

4.1.13. Multiple listings at the same street address: Listing more than 10 unique venues or services in unique listings at the same street address. Using the same titles, images or descriptions for these listings is also not acceptable. Using a showroom or generic photo without reference in the listing to the fact that the image is not that of the property advertised is not acceptable.

4.1.14. Large files: You must ensure that the graphic file submitted by you for your logo is no larger than 5MB in memory size.

4.1.15. Listing without authority: Listing property that you have not been authorised to rent or offer for service and for which you do not have a signed authority from the owner or vendor to use their property or service in such a manner as listed.

4.1.16. Impersonating other persons: Using the Service in way that is impersonating another person or persons.

4.1.17. Misleading or deceptive conduct: Using the Service in a way that does or is likely to mislead and deceive the public users of wedidit.wedding. This is the case regardless of what content is considered misleading or deceptive. Without limiting the generality of this restriction, we may deem the following conduct misleading and deceptive:

(a) Uploading incorrect information either in the description of the venue or service or in the key features, options, inclusion, pricing and availabilities for the venue or service.

(b) Uploading listings in the incorrect location, even if subsequently moved to correct suburb;

(c) Uploading photos that are not of the venue or service that would be deemed not accurate or misleading by any prospective customer

4.1.18. Failure to remove features and options no longer offered: Failing to use your best endeavours to remove or edit a listing from the Platform as soon as possible after any part of the current listing of features, options, services becomes no longer offered at the listing venue or service. For the purposes of the Acceptable Use Policy, we will regard a listing as being “changed” and require it to be moved to the sold database 72 hours following any of these events.

4.1.19. Rules for Content Containing Video/Moving Images/3D Tours (Video):

(a) Each Video on a listing must advertise a venue or service and focus predominantly on that venue or service. You must not use Video to advertise yourself or your business, except in that you may include a transparent watermark of your business logo in one corner of the Video with dimensions no greater than 10% of the total image size (i.e. 80 pixels by 60 pixels) that does not obstruct the Video content.

(b) Images and sounds in Videos must relate to the venue or service being offered.

(c) You must not use the Video Functionality in a way that is likely to mislead or deceive users of wedidit.wedding.

(d) You must adhere to the technical requirements for embedded property videos communicated to you from time to time.

(e) You must not use the Video Functionality for any unlawful, illegal, malicious or improper purpose. For example it is not acceptable to display images or include commentary that:

(i.) may defame or discredit another person or business;

(ii.) may disclose private, personal or confidential information;

(iii.) might be considered obscene, offensive, menacing or abusive;

(iv.) might infringe the intellectual property rights of others; or

(v.) may violate any law, regulation, standard, content requirements or code promulgated by any relevant authority or industry body.

(f) You must not include any agent contact details (e.g. phone, skype, email, social media or website address) other than the business name.

(g) You must have permission from all people shown in any video for use on the wedidit.wedding platorm.

(h) The above rules apply to all forms of moving images permitted by us for use on our Platform including images involving video, animated, virtual, rendered and scanned technologies. The general Acceptable Use rules apply to images and sounds in Videos, including without limitation sections 4.1.31 and 5 below.

4.1.20. Other inappropriate content: Using the Service for any unlawful, illegal, malicious or improper purpose or in a way that is inappropriate having regard to our need to maintain the quality of our Platform to ensure a positive experience for consumers. For example: it is not acceptable to, in your use of the Service, display material that:

(a) may defame or discredit another person or business;

(b) may disclose private, personal or confidential information;

(c) might be considered obscene, offensive, menacing or abusive;

(d) might infringe the intellectual property rights of others;

(e) may violate any law, regulation, standard, content requirements or code promulgated by any relevant authority or industry body.

4.1.21 Failing to verify the authenticity of listings: Allowing listings to be uploaded to our Platform for a person or entity using the listing for an improper purpose. An improper purpose includes to commit fraud against a consumer by impersonating a business in order to obtain funds by deception either through a non existant business or by incorrect information on a listing. Where this occurs, listings will be taken down without refund or recourse to return money and all relevant law enforcement authorities are advised.

5. BREACHING THIS POLICY

5.1. If you use the Service in a way that breaches this Acceptable Use Policy, you are in breach of a material obligation in your agreement with wedidit.wedding for your use of the Service.

5.2. Breaching this Acceptable Use Policy may result in us taking action to remedy the breach. This might include: terminating or suspending your subscription; deleting a specific listing, not permitting a listing to be uploaded to the site in the first place or any other action that we are permitted to take under our agreement with you and according to law.

5.3. For the avoidance of doubt, if we give you notice of a breach or breaches of this Acceptable Use Policy, we may require you to remedy those breaches AND otherwise become wholly compliant with this Acceptable Use Policy within the period specified in the notice. We reserve our rights to take suspension or termination action where you are in breach of ANY requirement of this Acceptable Use Policy at any time after the period specified in such a notice (and not only where you are in continuing breach of the specific requirements identified).

5.4. Where we suspend or delete listings or listings are prevented from being uploaded due to a breach or attempted breach by you of this Acceptable Use Policy, you will remain liable for your contractual obligations until the date of termination or expiration of your agreement with us.You may immediately terminate your agreement with us if we exercise our right to suspend or temporarily remove your listings for a period of 30 days or more.
